1. Agreement to These Terms

By adding, accessing, or using the Guess The Number Discord bot (the "Bot") in any Discord server or direct message, you ("User") agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease use of the Bot and remove it from any servers you administrate.

2. Eligibility

You must meet the following requirements to use the Bot:

• You must be at least 13 years of age. By using the Bot, you represent and warrant that you are 13 years of age or older.

• You must have a valid Discord account and comply with Discord's own Terms of Service, available at https://discord.com/terms.

• If you are between the ages of 13 and 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

• You must not be prohibited from receiving services under applicable United States law or the laws of any other applicable jurisdiction.

3. Description of the Bot

Guess The Number is a Discord bot that facilitates a number-guessing game for users within Discord servers and direct messages. The Bot may generate random numbers, accept user guesses, track scores and game history, and provide related game functionality. Features are subject to change at any time without notice.

4. Data Collection and Privacy

By using the Bot, you acknowledge and agree to the following regarding data collection:

• The Bot collections and stores certain data associated with your Discord user ID, including but not limited to: game scores, game history, win/loss records, and related gameplay statistics.

• This data is collected solely for the purpose of operating and improving the Bot's functionality, including leaderboards, score tracking, and user experience features.

• We do not sell, trade, or rent your data to third parties. We do not use your data for advertising or marketing purposes.

• Your data may be deleted upon request. To request data deletion, please contact us using the information provided in Section 10.

The collection and use of your data is further described in our Privacy Policy, which is incorporated by reference into these Terms. By agreeing to these Terms, you also agree to our Privacy Policy, found at https://gtn.jjgraz.com/legal/privacy-policy.

5. Acceptable Use

You agree to use the Bot only for its intended purposes and in compliance with these Terms. You agree that you will NOT:

• Exploit, abuse, or attempt to abuse any bugs, glitches, errors, or unintended functionality of the Bot for personal gain or to disrupt other users.

• Spam Bot commands or flood any channel with repeated Bot invocations in a manner that disrupts normal server operation.

• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Bot without our prior written consent.

• Use the Bot to harass, threaten, or harm other users.

• Use automated scripts, bots, or other tools to interact with the Bot in any non-standard or unauthorized way.

• Circumvent, disable, or otherwise interfere with any security-related features of the Bot.

• Use the Bot for any commercial purpose or for any public display without our express written consent.

• Provide false information or impersonate any person or entity while using the Bot.

6. Enforcement and Penalties

Jjgraz Bots reserves the right to take enforcement action against any user who violates these Terms, engages in abusive behavior, or otherwise misuses the Bot. Enforcement actions may include, but are not limited to:

• Temporary suspension of your access to the Bot.

• Permanent ban from using the Bot.

• Deletion or reset of your stored game data.

• Reporting of severe violations to Discord Trust & Safety where appropriate.

Enforcement decisions are made at the sole discretion of Jjgraz Bots. We are not obligated to provide notice prior to taking enforcement action, though we may do so at our discretion. You may appeal an enforcement action by contacting us using the information provided in Section 10.

7. Intellectual Property

All intellectual property rights in and to the Bot, including but not limited to its name, design, code, branding, and associated content, are owned by or licensed to Jjgraz Bots. Nothing in these Terms transfers any intellectual property rights to you.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Bot solely for its intended purpose in accordance with these Terms. This license may be revoked at any time.

8. Disclaimers and Limitation of Liability

8.1 Disclaimer of Warranties. THE BOT IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE BOT WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8.2 Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JJGRAZ BOTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE BOT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.3 Third-Party Platform. The Bot operates on Discord, a third-party platform. Jjgraz Bots has no control over Discord’s availability, policies, or actions, and shall not be liable for any issues arising from Discord’s services.

9. Modifications to These Terms

Jjgraz Bots reserves the right to modify these Terms at any time. When we make material changes, we will update the Effective Date at the top of this document. Your continued use of the Bot after any such changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of any updates. If you do not agree to the modified Terms, you must cease use of the Bot.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the appropriate courts of the United States.

12. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jjgraz Bots regarding your use of the Bot and supersede any prior agreements.
